1. About TMN PPE

TMN PPE (“TMN PPE”, “we”, “us” or “our”) supplies personal protective equipment, workwear and related products through tmnppe.co.za. You can contact us at sales@tmnppe.co.za or +27 76 867 9306.

Business registration, VAT and other mandatory supplier details should appear on our invoices and may be requested from us. If any website information conflicts with a written quotation accepted by both parties, the accepted quotation applies to that order.

2. Eligibility and authorised buyers

You must be at least 18 years old and legally capable of entering into a contract. If you order for a company, school, public body or other organisation, you confirm that you are authorised to bind that organisation.

Where an account or product is limited to approved buyers, we may request reasonable verification, including company details, procurement authority or identification. Approval is not guaranteed and may be suspended where information is false, outdated, compromised or used without authority.

3. Products, safety information and availability

We aim to display product descriptions, colours, sizes, specifications, certifications and images accurately. Screen settings and manufacturing batches may cause minor variations. Product images are illustrative unless stated otherwise.

You are responsible for selecting PPE that is suitable for the relevant hazard, task, environment and user. Product selection must follow applicable workplace risk assessments, manufacturer instructions and South African occupational health and safety requirements. Contact us before ordering if you need clarification about standards, sizing or intended use.

Stock is subject to availability. We may substitute a product only with your approval. If an ordered item is unavailable, we will contact you to offer a revised lead time, an alternative, a credit, or a refund for the unavailable item.

4. Orders and contract formation

Placing an order is an offer to purchase. An automated email confirms receipt only; a binding sale is concluded when we accept the order, confirm availability and payment, or dispatch the goods. We may reject or cancel an order before acceptance for stock errors, suspected fraud, an obvious pricing error, delivery limitations, or failure to meet authorised-buyer requirements.

Please check product, size, quantity, branding, delivery address and contact details before submitting. Changes after acceptance may affect price and lead time. Custom branding or made-to-order work begins only after artwork, specifications and any required deposit have been approved.

5. Prices and payments

Prices are shown in South African rand (ZAR). The checkout or quotation will state whether VAT and delivery charges are included. The final total is shown before payment or recorded in the accepted quotation.

Payment may be made using the methods offered at checkout or on our invoice. Payment providers process card or account details under their own terms and security controls; we do not receive your full card number. Goods remain our property until paid for in full, while risk passes as provided under the delivery section and applicable law.

If a price or description is clearly incorrect, we will notify you before fulfilment. You may accept the corrected order or cancel it for a full refund of any amount paid for that order.

6. Delivery and collection

Delivery dates are estimates unless expressly guaranteed in writing. Timing may depend on stock, customisation, payment clearance, courier capacity and the destination. We will communicate material delays and provide remedies required by law.

You must provide a complete, accessible address and ensure an authorised person is available to receive the order. Redelivery or storage costs caused by an incorrect address or failed delivery may be charged where reasonable and disclosed.

Inspect the package on arrival. Report visible transit damage, shortages or an incorrect item promptly, preferably within 48 hours, with the order number and photographs. This reporting period helps us investigate and does not remove statutory rights.

7. Cancellations, returns and refunds

Electronic transaction cooling-off

Where section 44 of the Electronic Communications and Transactions Act applies, an eligible consumer may cancel an electronic transaction within seven days after receiving the goods, without penalty. The consumer may be responsible for the direct cost of returning the goods. We will refund qualifying payments within the period required by law.

Change-of-mind returns

Outside a statutory right, we may accept unused, complete and resaleable standard-stock goods returned in original packaging, subject to prior authorisation and reasonable inspection. Contact us before sending anything back. Any collection or return cost will be explained beforehand.

Items that may not qualify

To the extent permitted by law, return rights may not apply to goods made to your specification, embroidered, printed, altered, specially sourced, damaged through misuse, or unable to be resold for genuine health, hygiene or safety reasons after a sealed package has been opened. These limitations do not remove rights relating to defective, unsafe, incorrectly supplied or misrepresented goods.

Refund method

Approved refunds are normally made to the original payment method. Processing time may depend on the payment provider. Delivery charges are refunded where required by law or where the full order was defective, incorrect, or not supplied as agreed.

8. Defective goods and warranties

Goods must be reasonably suitable, of good quality, in working order, free of defects and durable for a reasonable period, subject to normal use, care instructions and the product’s nature. Statutory protections, including those under the Consumer Protection Act, apply where applicable.

If goods fail to meet an applicable statutory warranty, contact us with proof of purchase and details of the problem. After assessment, you may be entitled to repair, replacement or refund as provided by law. Manufacturer warranties may provide additional protection but do not replace statutory rights.

Damage caused by incorrect selection, unauthorised alteration, neglect, abnormal use, ordinary wear, failure to follow instructions or use outside rated conditions is not a product defect.

9. Accounts, privacy and communications

You are responsible for safeguarding account credentials and notifying us of suspected unauthorised use. Information supplied to us must be accurate and current.

We process personal information to manage accounts, verify buyers, fulfil orders, take payment, prevent fraud, communicate with you and meet legal duties. Processing is subject to our Privacy Policy and applicable data-protection law, including POPIA. We may share necessary information with payment providers, couriers, service providers and authorities where lawfully required.

Operational messages about orders are not marketing. You may opt out of direct marketing using the unsubscribe method provided, while still receiving necessary transaction messages.

10. Acceptable use and liability

You may not misuse the website, attempt unauthorised access, introduce malicious code, scrape it unreasonably, impersonate another person, submit fraudulent orders, or infringe intellectual-property rights.

Website content is general product information and is not a substitute for a workplace risk assessment, competent safety advice, training or manufacturer instructions. PPE reduces risk but does not eliminate every hazard.

To the fullest extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed. Nothing excludes liability for fraud, gross negligence, death or personal injury caused unlawfully, defective or unsafe goods where liability cannot be excluded, or any other liability or consumer remedy that South African law prohibits us from limiting.

11. General legal terms

These terms are governed by the laws of the Republic of South Africa. The parties submit to courts with lawful jurisdiction, without preventing a consumer from using the National Consumer Commission, a consumer court, an ombud with jurisdiction, or another remedy available by law.

If an event beyond reasonable control delays performance, the affected duty is suspended only for the duration and extent of that event. We will take reasonable steps to minimise the effect and communicate significant delays.

If one provision is invalid or unenforceable, the remaining provisions continue to apply. A failure to enforce a right is not a waiver. We may update these terms for legal, operational or security reasons. The version displayed when an order is accepted generally governs that order unless a change is required by law or agreed with you.

These terms, the product listing, our Privacy Policy, Returns Policy, and any accepted quotation or order confirmation form the agreement. In the event of conflict, mandatory law prevails, followed by the accepted quotation or order confirmation, then these terms.
